1. Eligibility and Use of Platform
STOKART is a B2B wholesale platform intended solely for retailers, shop owners, and bulk buyers.
By using this Platform, you represent and warrant that:
(a) You are at least 18 years of age;
(b) You are using the Platform strictly for business purposes;
(c) All information provided by you is true, accurate, and complete.
2. Account Responsibility
You are solely responsible for maintaining the confidentiality of your account credentials.
STOKART shall not be liable for any loss or damage arising from unauthorized access due to sharing of login details.
3. Product Information and Pricing
STOKART makes reasonable efforts to ensure accuracy of product details, pricing, and availability.
However, STOKART reserves the absolute right to modify, update, or discontinue any product, pricing, or offer at any time without prior notice.
4. Orders and Payments
All orders are subject to acceptance, availability, and confirmation by STOKART.
STOKART reserves the right to cancel or refuse any order at its sole discretion.
Payments may be made via available online payment methods or Cash on Delivery (COD), subject to eligibility.
In case of failed transactions, chargebacks, or suspected fraudulent activity, STOKART reserves the right to take necessary legal action.
5. Delivery
Delivery timelines are estimates only and may vary due to operational, logistical, or external factors.
STOKART shall not be held liable for delays caused by third-party delivery partners or unforeseen circumstances.
6. Cancellation Policy
Orders may be cancelled only before dispatch.
Once the order has been dispatched, cancellation requests shall not be entertained.
7. Return, Refund & Inspection Policy
All products sold on STOKART are provided on a strict “No Return and No Refund” basis.
Customers must inspect the product at the time of delivery. Acceptance of delivery shall be deemed as confirmation that the product is received in satisfactory condition and as per the order.
In case of damaged, defective, or incorrect products, the customer must notify STOKART within 24 hours of delivery with valid proof (photo/video evidence).
Upon verification, STOKART may, at its sole and absolute discretion, provide a replacement only, subject to availability. No refunds shall be issued under any circumstances.
Failure to report issues within the specified timeframe or failure to inspect at delivery shall render the order ineligible for any claims.
All decisions made by STOKART in this regard shall be final and binding.
8. Limitation of Liability
To the maximum extent permitted by law, STOKART shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Platform.
9. Disclaimer of Warranties
All products and services are provided on an “as-is” and “as-available” basis without any warranties, express or implied.
10. Intellectual Property
All content on the Platform, including logos, text, graphics, and designs, is the exclusive property of STOKART and is protected under applicable intellectual property laws.
Unauthorized use is strictly prohibited.
11. Suspension and Termination
STOKART reserves the right to suspend or terminate any user account at its sole discretion without prior notice if any misuse, fraud, or violation of these Terms is detected.
12. Force Majeure
STOKART shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, strikes, pandemics, or governmental actions.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of courts located in Prayagraj, Uttar Pradesh.
14. Changes to Terms
STOKART reserves the right to update or modify these Terms at any time without prior notice.
Continued use of the Platform constitutes acceptance of the updated Terms.
